Disclaimer

Installation of Product: You acknowledge that you are responsible for any inspection and certifications required at law to ensure the installation and use of the Product is compliant with any laws of the jurisdiction of installation and use.

You acknowledge that installation and hookup is to be completed by a registered electrician, per the Vendor’s Product instructions.

Waiver: You do hereby release, waive, and discharge the Vendor, its directors, management, employees, and agents from liability from any and all claims, resulting in any personal injury, accidents, or illnesses (including death), and property loss arising from, but not limited to, the installation, use and removal of the Product sold by the Vendor. This waiver is binding on your heirs, successors, or assignees.

Assumption of Risks: Installation and use of the Product as an electrical product, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. You understand and agree that it is your responsibility to assess the hazards presented by your installation and use of the Product and further agree that you are the ultimate judge as to whether you can install and use the Product without risk of harm to yourself, others or property. This assumption of risks is binding on your heirs, successors, or assignees.

Covenant Not To Sue: You further agree that neither you nor your heirs, successors, or assignees will initiate or pursue any claim against the Vendor for damages or other losses sustained as a result of the installation and use of the Product.

Indemnification and Hold Harmless: You also agree to INDEMNIFY AND HOLD THE VENDOR  HARMLESS from any and all claims, actions, suits, judgments, procedures, costs, expenses, and liabilities, including but not limited to, personal injury, property damage or destruction, and death, as well as solicitor client legal fees brought as a result of your installation and use of said Product and to reimburse the Vendor for any such expenses incurred by the Vendor. This indemnification and hold harmless agreement is binding on your heirs, successors, or assignees.

Severability: The undersigned further expressly agrees that the foregoing Waiver is intended to be as broad and inclusive as is permitted by the laws in force in the Province of Alberta, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
